private funeral will be held. you are looking here at video of last night's wake in the massachusetts town of medford. the 29-year-old restaurant manager was one of three people killed in that bombing attack. the surviving bombing suspect remains in serious condition this morning. investigators say 19-year-old dzhokhar tsarnaev could be charged today. he's been able to answer some questions in writing. however, a gunshot wound to his neck has made it very difficult for him to speak. and there is also a very fierce political battle over how to question him. california senator dianne feinstein among those calling for that young bombing suspect to be treated as a criminal defendant. >> it is really very clear to me that the course that can be taken. you have the high value interrogation group. they are skilled, they know how to do this. >> however some republican lawmakers want to declare the

bombing suspect an enemy combatant. that would allow federal agents to question him without a lawyer. the fbi interviewed the older brother tamerlan tsarnaev two years ago. tipped off by russian -- why some lawmakers want no know if the fbi may have dropped the ball in this case. back here at home runners in marin county will be honoring the victims of the boston marathon bombings. they will take part in a 2.5- mile race that begins at 6:45 this evening. all runners are encouraged to wear blue and yellow clothing. that is the official colors of the boston marathon. for more information you can go to our channel 2 website ktvu.com. furloughs of air traffic

controllers could cause big delays this morning at airports across the country. ktvu channel 2 reporter tara moriarty is at sfo this morning with what passengers can expect. >> reporter: airline and pilot organizations are trying to stop the furloughs from happening by suing the faa but they are here and commercial flights really move flatly throughout the united states yesterday. but the real test will come together. that is because air traffic -- because of budget cuts all air traffic controllers must take one day off every two weeks. that means they will lose one traffic controller every day. santa rosa airport they were down at least one controller yesterday. folks there said they were concerned about safety and felt the government could have made cuts elsewhere. >> we are looking at a tiny percentage that needs if be

reduced. it's ridiculous they can't do that. you and i can certainly if we want to take $5 off of our spending for lunch over a month, it's easy for us to do. >> reporter: yesterday sfo and ma theta san jose reported no problems. sources inside the air traffic control tower here said four workers were furloughed yesterday. we still have to find out how many are furloughed today. meanwhile 100 contract towers in small airports across the country are scheduled to shut down in june. coming up we will have more reaction from passengers and we'll also keep an eye on the flights this morning and let you know if they are experiencing any delays. live from sfo i'm tara moriarty ktvu channel 2 news. this morning we are hearing the frantic 911 calls made after that deadly explosion at a fertilizer plant in west, texas. >> there was some sort of

explosion and our house all the windows are completely blown in. >> 14 killed in the explosion. 200 others injured. ten of those killed were first responders. >> i've got a nursing home and an animal station and an air evac. i need as many east texas terraqueous cuff send this way. >> over the weekend about 200 evacuees were allowed to return home. they do face strict cur pays and they have limited water and electricity. a san jose woman accused of stealing a car with a baby inside is expected to enter a plea in court. carlos hernandez is facing kidnapping, child endangerment and car theft. an amber alert was issued and

about five hours later police found that car abandoned with the baby inside. the child was not hurt. this morning people living in a growing homeless camp in the south bay are being told they have to move. ktvu janine de la vega is joining us live in san jose where a homeless camp sweep is expected to happen in a couple of hours from now. janine. >> reporter: dave, we are across the street from kelly park where you can see behind this chain link fence they have ripped through here so they could go down near the creek. there has been no trespassing signs that we have seen all along here. but this encampment camp we were told to stay away from it. because of the hostility we might face. the homeless people living here have made it a point to hide themselves from the public. city officials have been eyeing this encampment for several months. they cleared it out last october. removing 50 tons of trash and debris. now the city estimates 125-175

people have moved back in setting up structures near the creek. they described the camp as being heavily entrenched. some people are actually driving down access roads and leaving their cars near their camp. a project manager from the housing department says a cleanup crew aloss with police and animal control will start showing up here at 8:30 a.m.. the cleanup begins at 9:00. coming up in the next half hour of the morning news. we will tell you about some of the deterrents. reporting live janine de la vega ktvu channel 2 news. starting today most cities in san mateo county are joining the ban on plastic bays. you will need to bring -- if you forget, you are going to be

charged from tent don'ts per april bag. time now 5:07. sal is back. ready to do what he does best. are you going that cake care of the folks on the east shore? >> yeah we are looking at that. traffic is doing pretty well here if you are driving on 80 westbound as you know we looked at it pretty closely. a lot of people coming in from the carquinez bridge and heading out to richmond and berkeley. no problems at the bay bridge toll plaza this morning when you get there. we usually don't see a crowd until about 6:00. so you have a little bit of time to jump ahead of the crowd. westbound 580 into the livermore area there was a crash in the center divide. it wasn't in the lanes but it's causing a little bit of slow traffic as you can see coming in from the altamont pass. no major problems after that into dublin. 5:08 let's go to steve. thank you. clear skies. it will be another warm day. close to some records.

85 santa rosa. that would be shy. 1987 was very, very warm on that date. i think we will be close but it will just come under the wire of just not getting close enough. san francisco's record high was 90. also in 1987. they will not be close to that. this is a really tricky forecast pip think they set their high for the day at noon. by 4:00 there is a big fog bank coming up the coast and roaring down the coast. believe me around 3:00 or 4:00 if it doesn't kick in then it will kick in later. otherwise most of the day looks good. we are clear right now waiting for a westerly breeze. there is fog there. there is fog there. not here yet but it's on its way. lots of sunshine won't make an impact. upper 80s to near 90 away from the coast. 48 novato. 46 napa. that was pretty cool there. 46 half-moon bay.

time is 5:13. we have developing news in afghanistan. nine people are being held hostage by the taliban. they were captured after their helicopter made an emergency landing in bad weather.

they landed in an area controlled by insurgents right near the border with pakistan. now in a news conference in kabul nato officials said all of the passengers are civilians. eight are turkish engineers. the pilot is from afghanistan. >> we are assisting the afghan authorities in the search for this helicopter and this is all i can tell you for the time being. >> nato is saying they still don't know the condition of the hostages. also new this morning, police are investigating a shooting at an apartment complex south of seattle washington where five people are dead. when police arrive to that complex in federal way they found two injured men on the ground. police say they shot one of the men after he reached for a gun. police then found three other victims throughout that complex. officials say it appears the shooting happened after a fight. some lawyers in washington, d.c. are criticizing the fbi

over the boston marathon bombing case. as ktvu kyla campbell reports from our washington, d.c. newsroom some believe the fbi could have done more to prevent the terror attack. >> reporter: lawmakers from both parties says the fbi failed to closely monitor the bombers. he is suspect number one. killed in a shootout with police late last week. some experts who have been checking into tsarnaev's fbi activity says he is very radical and checking out jihaddist websites. they interviewed him in 2011. but they did not find evidence of suspicious activity but didn't find anything. that is the big question. because some lawmakers believe he might have been training overseas to pull off that terror act in boston. why some say the fbi had no choice but to close the case.

when i see you next. live in washington, kyla campbell ktvu channel 2 news. the man accused of mailing a letter containing the poison ricin to president obama is expected back in court today. he has denied any involvement in the letter sent to the president or other letters sent to a senator and judge. his attorney says authorities have little evil connecting him to the evidence. today marks three years since bp's deep water horizon oil platform sank in the gulf of mexico following a how long explosion. that explosion killed 11 workers. it also caused an oil leak that lasted for almost three months. almost five million barrels of oil leaked into the gulf of mexico. damaging marine and wildlife habitats as well as the fishing and tourism industries of the gulf coast. 5:16 is the time. could be a little busier today. think most of all schools are back from spring break and

really cold. 47-49 degrees. that is really cold. high pressure still giving us a tiny bit of an offshore push but it's not wide spread. there is a little bit also of a component of a westerly breeze trying to take hold. and there in liesth room. a lot of 50s for everyone else. 57 san francisco and oakland. it's really mild for some. northwest, southwest, northwest, easterly napa. easterly livermore. calm for most locations. you need to keep an eye on that westerly breeze. 30s to 60s from tahoe to sacramento. high pressure right over the west coast. it looks like it will break down a little bit tomorrow. and then really little low coming in on wednesday will give us a big time cool down. today sunny and warm be 80s to near 90s. low to mid to upper. 70s near the coast. also in san francisco. but again i think that late sea breeze comes in. 84 yesterday in santa cruz.

welcome back to the ktvu channel 2 morning news. 5:23 is the time. we do have new information this morning about that deadly avalanche in colorado that killed five people over the weekend. the group of experienced snow borders was testing out avalanche safety gear as part of a community event promoting back country safety. the victims were snow boarding in the rocky mountains saturday at love land pass when the 650- foot wide avalanche buried five men. the six snow border managed to dig himself outs. authorities also released the

names and ages of the victims. they ringed from 32 to 36 years old. time is 5:23. former astronaut and gun control activist mark kelly brought his bush to the bay area. he was speaking at a community college invention at san francisco. kelly become a gun control advocate after his wife gabrielle giffords was severely injured in a mass shooting in tucson. even though proposed gun control legislation failed in the senate last week, kelly said he is not giving up his fight. >> we are raising millions and millions of dollars and we will try to educate the public on not only how their member of congress voted, but how they feel about this issue. >> the community college convention is being held at san francisco's mosconey center through tomorrow. california students are fighting a bill that would raise their college costs. it would raise fees for high demand summer and winter courses at community colleges.

the bill's author says it sames at helping schools which have dropped classes due to funding cuts. students are organizing protests. time 5:24. oakland native is being considered for the superintendent position at the oakland unified school district. yesterday's announcement comes as current superintendent tony smith plans to resign in june because of family reasons. they will vote this wednesday on yee's candidacy. he has previously served as schoolteacher, principal, and administrator in that school district. san francisco drivers can expect to see more people on their bikes this week. bike to school week starts today. dozens of schools takes part in the event which means more than 2,500 students and parents will be sharing the road today. so get started any time of week

we are told that his condition is listed as serious. meanwhile this is a tough week ahead as memorial services have started for the victims. people waited in line for hours sunday evening to pay their respects toes family of crystal campbell. >> everyone is coming together to make sure that the family is doing well. >> reporter: the 29-year-old was one of three killed last week in the boston marathon bombings. this will likely be a week marked with tears as families say goodbye to the victims. >> i hope god will give it a lot of strength to her ands family. >> reporter: at the same time authorities are forging ahead with their investigation. they want to know exactly what the motive was for the deadly attack and how it was carried out. the person with the most questions to answer is 19-year- old dzhokhar tsarnaev. he remains hospitalized with several injuries. including a gunshot wound to the neck. >> it's hard to say how he received that injury. there was a shootout in water

town. there were explosives found. >> reporter: his older brother tamerlan also wanted by the fbi died in a shootout with police. >> i told the people of boston they can rest easily. the two people committing these vicious attacks are either dead or arrested. and i still believe that. >> reporter: the threat may be over but the grieving and healing have only just begun. and dave, slowly and surely they have started to reopen copley square and boylston street where the bombings took place but it will be a huge under taking. they say they have to decontaminate the area, clean up the debris. make sure the buildings are structural sound but they also have to move some of the memorials that people left there. they do plan to put up sign so people can walk up to the area and share their thoughts because no one here has forgotten that happened just a week ago. >> tori, thank you for that

update from boston. california senator dianne feinstein says she is against labeling the 19-year-old boston bombing suspect an enemy combatant. to declare dzhokhar tsarnaev of an enemy combatant. she does not believe he qualifies for the designation. today could be the real test of the effects of the sequester on air travel. it's the first weekday since furloughs of air traffic controllers took effect. all air traffic controllers must take one day off every week due to budget cuts. that could cost staffing problems and delays at the nation's busiest airports such as sfo and smaller airports like santa rosa. >> they will have to step it up and work with the skeleton crew. the thing is the tower is not going to shut. >> reporter: major hubs such as

atlanta and new york could see delays of several hours. los angeles airport saw delays of more than three hours this weekend due to the staffing cuts. time is 5:33. police in richmond investigating a shooting last night not far from where a 16- year-old boy and his sister were shot and killed last week. police say a man was shot last night while sitting in his car on griffin drive. the shooting happened near mclaughlin way. that is where a 16-year-old boy and his 19-year-old sister were gunned down on thursday night. a church pastor in richmond says this violence hits close to home because just two weeks ago his own brother was shot. >> any one of these young men shot up my grandmother's house and shot my brother who wasn't the intended victim. >> reporter: police in richmond are investigating all three shootings. so far no arrests have been made. it may take several days to know what killed a san lorenzo

woman who was found in a pool of blood. she was found on silver leaf drive. alameda county sheriffs deputies have only described her as a woman in her 50s. now investigators want to know if the death was an accident or homicide. in just a few hours the growing homeless camp in san jose will be clear. janine de la vega is in san jose to tell us how the city plans to keep them from returning. janine. >> reporter: pam, people who live in this encampment have been told they cannot come back here. we actually spoke to two men a short while ago who said they don't know where they are going. they left in a car. you can see people have been gaining access down here near coyote creek by going through the chain link fence that has been torn apart there. now let's go to video we took earlier. city officials estimate 125-175 homeless people have set up camp near coyote creek close to kelly park. it's a lot of single adults and couples as well as their pets. this is the second time the

city has done a clean up here. crews were here last october and removed 50 tons of trash and debris. city officials say they are concerned about the pollution of the creek. people are driving their cars down access roads and leaving them there to reach their camp. the project manager of the cleanup says the city plans on closing off the access roads and hiring private security to prevent the homeless from coming back. work crews, police, and animal control as well as outreach workers will be here at 8:30 this morning. the actual cleanup begins at 9:00 a.m.. now they realize that this is just a short term fix. coming up at 6:30, we'll tell you where the city is at as far as solving this larger issue of homelessness. reporting live from san jose janine de la vega ktvu channel 2 news. time now 5:36. starting today most cities in san mateo county will charge customers for single use plastic and paper bags. ktvu alex savidge is joining us

live from belmont with the details on this new ban and also stores that are an exception to the rule. alex. >> there are some. but you know if you live most anywhere in san mateo county, well, you can say goodbye to the plastic grocery bags because today they will no longer be allowed at checkouts. this is all meant to coincide with earth day today. it takes effect in a dozen cities here in this county. the ban applies to super markets, pharmacies, and convenient stores although there is an exception for restaurants as well. you will be able to get those small plastic bags for your produce when you two to the grocery store as well. county leaders say the issue here is that plastic bags end up as litter or landfills and the cleanup costs can be immense. now if you forget to bring your own reusable bags which is what is being encouraged here, grocery stores will have to charge you 10 cents for paper bags at check out.

that doesn't sit well with some. >> i feel they are already getting money from taxes that they charge you. they charge you for everything in the world. and i just think it's an added cost. >> they are messy. people throw them everywhere. they do plug things up. i would like it to be cleaner for my grand kids. >> now according to san mateo county health system, californians use about 20 billion plastic grocery bags every year. that is why a growing number of communities all across the bay area are putting similar bans in place in an effort to offset all of the cleanup costs. as we bring you back here live here in san mateo county they are really trying to launch an education effort and get people used to this new bag ban. you can see they have a sign posted here at the entrance to the store. and in many case there is is a store that will hand out reusable bags for free. we are live this morning in belmont alex savidge ktvu channel 2 news. time now 5:38.

[ laughter ] i know i have them. i just forget. lots of sunshine. very warm conditions on the week. i had to crank up the ac. sunny skies. as my mom says anything over 75 is too hot. i understand those of you out there feel that way. others it was nice. it wasn't that bad but we're way above average. high pressure gave us a warm, warm weekend and it will give us a warm monday. however, there is fog coming up the coast and down the coast. they are not here yet but they will be here tomorrow. possible records today. i think they fall just shy. the forecast tools that i use the forecast high temps were actually cooler than what i'm going with. so we'll see how that plays out. the lows are running a little bit above average although some locations novato and hayward -- hold on novato and napa are in the 40s. we are hard pressed to get to

80-86. the records are closer to 90. 1987 on this date was really warm. that won't even come prose today. i might be looking for a late sea breeze but not before they hit 75 at noon. and then i dropped it pretty fast here this afternoon. fog is getting really close. 50 in walnut creek. 46 in novato. 59 redwood city. that is probably in higher elevation. 58 hayward. sfo and san francisco that is pretty warm. now there is a it will bit of an easterly breeze for some. yet there is a westerly northwest or southwest for others. not that strong. it's not going to make much of an impact away from the coast. just by the immediate coast it might. there is a little bit there. and the southerly surge what we call right off of about santa remarry yeah fog is coming up. that will play into santa cruz's forecast tomorrow. believe it or not there is still snow in the forecast. i know the miami marlins are playing the minnesota twins today. it's currently 37 and there is

earthquake hit new mexico. the earthquake was in the mexican state of micquan. that is 200 miles away from mexico city. but people in the capitol could feel it as well. some people lost power. there was no immediate reports of damage or injuries. the raceway is shut down after a woman was killed. it happened sunday morning in desert center. that is about 150 miles east of los angeles. the 21-year-old woman was killed when the driver of a car lost control and hit a concrete barrier. in the meantime, that driver was air lifted to a nearby hospital with major injuries. there is no word on when that raceway will reopen. back here at home north vallejo little league games will be played today after a temporary suspension following a shooting last week in the field's parking lot. it happened wednesday night on the parking lot of thurman field. shots were fired following an
